FCC has upheld its decision to fine CBS more than half a million-dollars for Janet Jackson`s controversial halftime performance during Super Bowl 38. Her performance ended with singer Justin Timberlake ripping off a portion of Jackson`s bustier, which exposed her breast to a worldwide television audience.
The fine of $550,000 was arrived by applying the maximum offensive broadcast fine to each CBS station.
CBS affiliates, on the other hand, face no fines.
The FCC said that was because no affiliate was involved with the selection, planning or approval of the offensive material.
CBS tried to oppose the fine by arguing that Jackson`s exposure was neither intentional nor indecent.
The FCC also proposed fining dozens of CBS stations $32,000 for an episode of “Without A Trace.” The episode in 2004 depicted a sex orgy with boys and girls.
